Welcome to Paintingify. By visiting www.paintingify.com, creating personalized artwork, or purchasing a product, you agree to these Terms and our Privacy, Shipping, and Returns and Refunds policies.

Eligibility and Order Information

You confirm that you have reached the legal age required to enter a contract in your jurisdiction or have permission from a parent or legal guardian. You must provide accurate and complete contact, payment, customization, and delivery information and are responsible for the security of your account and devices.

Uploaded Content and Personalized Artwork

You confirm that you own or have permission to use every photograph, name, and other item you upload. You must not submit unlawful, infringing, fraudulent, hateful, sexually explicit, malicious, or privacy-violating content. We may refuse an order that violates these Terms or applicable law.

You authorize Paintingify and the service providers needed to fulfill your order to process uploaded content for artwork generation, printing, delivery, customer support, security, and legal compliance. AI-generated artwork naturally includes artistic variation and may reasonably differ from examples in pose, background, details, or color.

Products, Pricing, and Payment

We make reasonable efforts to display products accurately, but screens and printing processes may produce reasonable color differences. Prices, discounts, and availability can change. The price, tax, and shipping charge shown at checkout when you pay govern the order. We may cancel and refund orders involving suspected fraud, obvious pricing errors, inability to fulfill, or violation of these Terms.

Delivery, Cancellation, and Refunds

Digital files are generally provided after processing. Canvas prints are made to order and all production and delivery times are estimates. Cancellation may be restricted after digital generation or physical production begins. Our Shipping and Returns and Refunds policies contain the applicable details and do not exclude mandatory consumer rights.

Intellectual Property and License

The website design, trademarks, copy, samples, software, and content not uploaded by customers belong to Paintingify or its licensors. They may not be copied, sold, scraped, reverse engineered, or used to build a competing service without permission.

After full payment and delivery, customers may use the completed personalized artwork for personal, family, and non-commercial purposes. Commercial sale, trademark registration, mass reproduction, or sublicensing requires written permission unless the product page expressly grants a commercial license. Rights in the original uploaded photograph remain with its lawful owner.

Prohibited Conduct

You may not use the service unlawfully, infringe another person’s rights, transmit malicious code, interfere with security, access systems without authorization, scrape content at scale, make fraudulent payments, or abuse regeneration, refund, or dispute processes.

Third-Party Services and Liability

Our store is powered by Shopify and may use independent payment, analytics, image-processing, printing, and shipping providers. To the maximum extent permitted by law, the service is provided as available. We do not guarantee uninterrupted access, that every artistic result will match a subjective expectation, or that estimated delivery dates will always be met. Nothing in these Terms limits rights or liability that cannot lawfully be excluded.

Changes and Contact

We may update these Terms for business, technical, or legal reasons and publish the revised version here. If one provision is unenforceable, the remaining provisions continue to apply. Disputes should first be addressed in good faith and remain subject to mandatory laws applicable to the transaction and customer. Questions should be sent to service@shopupup.com.
